Privacy Policy

Protecting your privacy is important to us. We therefore consider it essential to inform you about the manner in which we collect, store, use and process the personal data and information that you communicate to us through this website (the Site). In general, we collect your personal data only through the contact form and during consultation of the Site (see the Cookies section).

This Policy covers “the personal data and information” that we collect through this Site. “Personal data and information” is personally identifiable information taken individually or in combination with other information available to us.

We endeavour to be as clear as possible. However, if you are not familiar with, for example, the terms “cookies”, “IP addresses”, “pixel tags” or “browsers”, find out about these terms beforehand.

What information and personal data do we collect?

Personal data include all data that allow us to identify you.

We may ask you to provide us with your name, telephone number, email address, geographical location as well as certain information concerning your company and your job or any other information that you might give us of your own initiative via our contact form.

This information can be stored in our administrative and contact databases according to the work we have done or are doing with you, or because you wish to receive documentation from us about our company and our services. This allows us to effectively manage our relationship with you, and to improve our Site. Our databases are hosted by OVH in France.

In addition to the aforementioned personal data, the Site automatically records login information provided by the browser used by the visitor to access the site (Internet Explorer, etc.). This information includes data about the visitor’s IP address, the pages of the site viewed from this address and the last website visited by the visitor before this one. As the European jurisdictions consider IP addresses as personal information, we inform you that none of this browsing data is used by Agronutrition for the direct or indirect identification of the visitor who visits the Site. Browsing data is used anonymously to identify potential Internet server problems, to administer the Site and to collect general demographic data to make the Site more useful and attractive to our visitors. This data is kept only for the time during which the Site is consulted.

Cookies

A cookie is a small data file that websites install on the visitor’s hard drive when he/she views a site. A cookie file contains information that can be used to recognise a visitor each time they return to a site. The data is encrypted for greater security.

We use “cookies” to measure the level of activity on the Site, traffic on the Site and to collect information in order to continually improve the visit to the Site, and to support certain functionalities. For example, we may use these technologies to collect information about how visitors use the Site – what pages they view, what links they use, and how long they stay on each page;

In general, the information we collect using these cookies does not allow you to be identified directly. If you do not wish to receive cookies, you can set your browser to reject cookies or warn you when cookies are placed on your computer. You can also delete our cookies as soon as you leave a Site.

For more information, please refer to the Cookies Policy.

How do we use the data we collect?

In general, we use the personal information we collect through our site:

  • to improve the content, functionality and usability of our Site;
  • to improve our products and services;
  • to improve our marketing and promotional activities
  • to answer any questions you may have about the application/dosage/compatibility of our products with your crops

In addition, it should be noted that the personal data as well as the browsing data collected on the Site may be used, if necessary, by staff of the Agronutrition or the DE SANGOSSE Group in charge of security to protect against a threat or other security risk, and such data may be forwarded, where appropriate, to the competent authorities.

To whom do we communicate the data collected?

We disclose personal information to our internal departments and, as appropriate, to companies and organisations that provide services on our behalf, for example, companies that provide us with support services (such as data storage, web hosting or maintenance services – in this regard see our Terms of Use of the Site). These third-party companies are contractually bound to use the personal data we provide to them for the sole purpose of providing services on our behalf and they have the contractual obligation to take commercially reasonable measures to protect the confidentiality and security of your personal data.

If you do not want us to share your personal data with another department of the company, you may “withdraw your consent” at any time by sending an email via our Contact form or to the address: accueil@agro-nutrition.fr We may disclose your personal data if we believe in good faith that such disclosure is appropriate to comply with the law, a court order, or subpoena to testify. We may also disclose your personal data in order to avoid a potential offence or to investigate an alleged offence, such as fraud or identity theft; to apply or enforce our online terms of use or other agreements; or to protect our own rights or property, or the rights, property, or security of our users or third parties.

Your consent

By using this Site, you have accepted the practices described in this Policy (including the Cookie Policy that is available on this Site). If you do not agree to this Policy, please do not use this site. As for your personal data, other than the navigational data, you will be communicating this to us in full knowledge when you personally complete the input form that is offered on the Site.

Direct Marketing

Before using your personal data for direct marketing purposes (or allowing our affiliates to do so), we will give you the opportunity to choose whether your data can be used for this purpose. No direct marketing will be conducted without the receipt of your prior consent. If at any time you wish to be removed from our direct marketing mailing lists, please send your request via our contact form or to the address accueil@agro-nutrition.fr. To do this, please provide your full name, address and email address so that we can find you in our mailing lists. Once we have the necessary information, we will remove you from our mailing lists (see “What are your rights?”, “What actions do we have to take?” in this policy).

Children/adolescents and privacy

Our Site is not intended for children (unemancipated minors), nor does it target them. We do not knowingly collect information from – or concerning – minors, and even less so without the consent of a parent or legal guardian.

If you are a minor, do not give us any personal information. If we learn that a minor has provided personally identifiable information through our Site, we will use reasonable means to erase that information from our databases.

What are your rights?

We reserve the right to make changes to this Policy at any time. Any changes will be published in this Policy. We encourage you to review this Policy regularly to ensure that you are aware of any changes and of how your personal information may be used.

You can exercise your right of objection at any time as well as your rights of access to the data concerning you and have them rectified, deleted, limited or ported via our contact form or by contacting: accueil@agro-nutrition.fr

What does this mean?

Information (Articles 13 and 14 of Regulation (EU) 2016/679): when the data is collected, we must inform you as to the purposes of the processing or of your rights. You will have been reminded of this before completing the form on the website but also via this notice.

Right of access (Art 15 of Regulation (EU) 2016/679): you have the right to obtain confirmation as to whether the collected data has been processed, and if so, access to these data as well as certain information such as that mentioned above.

Right of rectification (Art 16 of Regulation (EU) 2016/679): you have the right to have inaccurate data rectified and incomplete data completed, as soon as possible.

Right to cancellation (Art 17 of Regulation (EU) 2016/679): you have the right to have such data deleted as soon as possible, when you have withdrawn your consent to its processing, when you object to it, when the data is no longer necessary for the purposes of the processing, when it has been the subject of unlawful processing, or where it must be erased by virtue of a legal obligation, except in certain specific cases which we will indicate to you where necessary. If we have made this data public, we will be obliged to inform the other data controllers who process it that we must erase this data and any reproductions thereof.

Right to limitation of processing (Art 18 of Regulation (EU) 2016/679): you have the right to have the processing restricted when you object to it, when you dispute the accuracy of the data, when the processing thereof is unlawful, or when you need it for the declaratory judgement, the exercise or the defence of your rights in court.

Right to portability (Art 20 of the Regulation (EU) 2016/679): when the processing is based on consent, or on a contract, and is performed using automated processes, you have the right to receive the data in a structured, commonly used, machine-readable and interoperable format, and transmit to another data controller without our being able to make any hindrance.

Right of objection (Art 21 of the Regulation (EU) 2016/679): You may object at any time, for legitimate reasons, to being included in a file. In the case of canvassing, in particular for sales purposes and including the profiling connected with such canvassing, this right can be exercised without having to offer any reason in justification.

Automated decision making (Art 22 of Regulation (EU) 2016/679): you have the right not to be the subject of a decision based exclusively on automated processing, including profiling, that produces legal effects concerning or affecting you, except (i) where this decision is necessary for entering into or the performance of a contract, (ii) is legally authorised, or (iii) is based on consent thereto.

What actions do we have to take if you exercise one or more of your rights?

In the event of an exercise of one of the rights mentioned above, we will send you a response within one month of receipt of this request. Given the complexity and the number of requests, this period may be extended to two months, in which case you will be informed of the extension and the reasons for the postponement within one month of receiving your request. For each request, please provide your full name, address and email address so that we can find you in our files.

When this request is submitted electronically, you will receive the response in the same format unless you request a different one. We would ask you to submit a request to the following email address: accueil@agro-nutrition.fr.

In order to protect your data, we inform you that in case of reasonable doubt as to your identity, we reserve the right to request additional information necessary to confirm your identity prior to compliance with any of the rights you wish to exercise.

We may not demand any payment for the exercise of one or more of these rights. However, in the event of a manifestly unfounded or excessive request, we will be entitled to request the payment of the administrative costs corresponding to these requests or to refuse such requests.

In the absence of response from us, you will be informed in the month following receipt of your request of the reasons for our failure to take action. You will then have the opportunity to lodge an appeal with the National Commission for Data Processing and Individual Rights located at PARIS CEDEX 07 (75334), 3 Place de Fontenoy – TSA 80715 and/or to lodge a judicial appeal.

What is the retention period for personal data?

We periodically destroy Personal Data if there is no longer any reason for its use or disclosure in accordance with the terms of this Policy. Unless you request otherwise your data will be kept for one year when we have no direct business relationship with you and three years otherwise.

How do we protect personal data?

We take all necessary precautions to preserve the security and the confidentiality of the personal data which you will have transmitted to us, in particular to prevent it being deformed, damaged, or accessed by unauthorised third parties.

In this respect, we undertake not to access or use the data for any other purpose than to fulfil the purposes communicated to you. We also implement, directly or through our service providers, (a) identity and access controls via an authentication system as well as a password policy, (b) user and administrator authentication processes, as well as measures to protect administrative functions, (c) processes and devices to trace all the actions performed on the information system, and, in accordance with the regulations in force, to perform reporting actions in the event of an incident impacting your data.
